Terms and Conditions - NCH Events and Decor
Welcome to NCH Events and Decor (Pty) Ltd.
These Terms and Conditions outline the guidelines for using our services, encompassing the rental of events equipment and decor setup for your events.
Definitions
In these terms and conditions, the following expressions, unless otherwise stated, bear the following meanings:
- "We," "us," "our" means NCH Events and Decor (Pty) Ltd.
- "You," "your" means the customer renting equipment and/or availing decor setup services.
- "Equipment" means the items rented from us.
- "Services" means the decor setup services provided by us, as well as all the other services listed on Services.html page.
Rental of Equipment
By entering into an agreement with us for equipment rental, you agree to the following terms:
- Equipment rented/hired from NCH Events and Decor (Pty) Ltd. remains the property of NCH Events and Decor (Pty) Ltd. at all times.
- You agree to rent the equipment for the specified period mentioned in the quote/invoice, a basic rental period is one(1) day or 24hours.
- The rental fee specified in the quote/invoice is payable in advance.
- Please be informed that we work strictly on a 1st come 1st serve basis due to limited amounts of stock per item.
- You agree to return the equipment in the same condition it was rented, and in it's proper packaging.
- Any damages to the equipment during the rental period is exclusively your responsibility.
- Any loss or damage to the rental equipment will be charged at the current cost or replacement value, (the replacement price on documents are a guide price, subject to what suppliers will eventually charge).
- Customers' goods cannot be accepted as replacements.
- For all orders, a refundable deposit covering a small percentage of the value of the rented equipment will be charged to cater for loss or damage.
- The deposit, less any costs for breakages or losses, will be returned after the hired items have been checked.(please allow at least a week to refund).
- In cases where the refundable deposit is insufficient to cover the replacement cost, you will be liable for the remaining balance.
- Linen should be handled with care. Burnt, mildewed, candle waxed, torn, or heavily stained cloths will be charged at the full replacement cost.
Usage and Care of Rental Items
- We kindly request that you exercise due consideration when handling our inventory. A substantial portion of our merchandise consists of limited, imported stock, which holds intrinsic value and cannot be readily replaced.
- It is imperative to recognize that the subsequent client is entering into an agreement to receive the rented items in an optimal, undamaged condition. Any avoidable harm or negligence resulting in damage may incur additional costs, as the next client is expected to receive the items in the same state as they were initially provided.
- We appreciate your understanding and cooperation in preserving the quality and integrity of our offerings.
Decor Setup Services
When availing our decor setup services, you agree to the following terms:
- Decor setup services are provided for the duration specified in the quote/invoice.
- The service fee mentioned in the quote/invoice is payable.
- You will arrange / provide venue access at a reasonable and adequate time-frame before the event, depending on the scope of the work.
- Access to all other facilities such as kitchen, cold room, etc to be arranged by you with the venue establishment.
- A detailed floor plan of the venue must be provided at least 2 weeks before the event.
- We only setup equipment provided by ourselves, not any items belonging to another party, unless there is a prior arrange in place.
- We will provide event setup, styling, and teardown services as agreed upon in the contract. This includes the design and arrangement of event spaces, decorations, lighting, props, and any other elements necessary to create the desired atmosphere and aesthetic for the event.
- We kindly request that you acknowledge the potential impact on our operations and ability to meet our agreed-upon obligations in a timely and professional manner when hindrances or interferences arise. These may include instances when early or timeous access to the venue is not provided, when rehearsals take place in the area designated for our setup,when items that you need to provide is not timeously received, or when another service provider also utilizes the same setup/styling space. Please be aware that such hindrances and interferences may result in additional charges to compensate for the extra resources required to accommodate these challenges and fulfill our commitments satisfactorily.
Delivery and Collection
Delivery:
- We will strive to deliver the rental items to the specified location on the agreed-upon date and time.
- Delivery charges will apply based on the distance and complexity of the delivery.
- It is you, the client's responsibility to ensure that someone is available at the location to receive the items during the agreed-upon delivery window.
- Deliveries to third partys or unoccupied premises are made entirely at you, the client's risk.
- In the event that delivery cannot be completed due to the absence of the client or an inaccessible location, additional charges may apply for rescheduling or extra delivery attempts.
Collection:
- Rental items should be available for collection at the agreed-upon date and time.
- The client should ensure that all items are ready for collection and easily accessible.
- Late fees may be applied if the items are not ready for collection or if the collection is delayed due to the client's actions or unavailability.
- The client should inform us in advance if there are any changes to the collection schedule.
Client's Own Collection and Return:
If you, the client, prefer to manage the collection and return of the rental items, please notify us in advance. In such cases:
- You will be responsible for the timely collection of the rental items from our specified location.
- The items should be returned to us on or before the agreed-upon date and time
- Late fees will be applied if the items are not returned on or before the agreed-upon date and time.
- You must ensure that all rental items are returned in the same condition they were received.
- Please inform us promptly of any changes to the collection or return schedule.
- As a requirement for own collection, you are obligated to provide the following documents:Valid Identity Document or Passport or Driver's License.
Proof of residence not older than 3 months.
- All provided documents will undergo verification.
By opting for your own collection and return process, you acknowledge and agree to adhere to the terms outlined herein. It is important to communicate your preference with our team to facilitate a smooth coordination of the rental process.
Liability
- We are not liable for any loss, damage to your property, or injuries during the rental or decor setup period.
- You are responsible for any loss or damage to our equipment during the rental.
- Any injuries to our employees during the decor setup period are your responsibility.
Payments
Payment Terms:
- You,the client agrees to pay NCH Events and Decor (Pty) Ltd the agreed-upon fees for the services provided.
- A deposit of 50% of the total cost is due upon signing the contract to secure the booking, provided that there is at least two(2) weeks time frame from signing the contract to the actual Event Date, else the full amount becomes immediately due.
- The remaining balance must be paid 7 days prior to the event.
- Late or partial payments may result in additional fees or cancellation of services.
Payment Methods:
- Payments can be made via bank transfer (EFT), cash , or any other agreed-upon payment method.
- You, the client is responsible for any transaction fees associated with the chosen payment method, this is especially true for direct cash deposits into our account.
- The remaining balance must be paid 7 days prior to the event.
- Late or partial payments may result in additional fees or cancellation of services.
Additional Charges:
- You, the client shall be responsible for any additional expenses incurred due to changes or add-ons requested after the contract is signed.
- Any costs associated with venue-specific requirements (e.g., permits, security deposits) shall be borne by you, the client.
Dispute Resolution:
- In the event of any payment disputes, both parties agree to engage in good faith negotiations to reach a satisfactory resolution.
- If a resolution cannot be reached, the dispute shall be resolved in accordance with the governing law and jurisdiction specified in the contract.
Non Payment:
- Failure to make payments as outlined in the contract may result in NCH Events and Decor (Pty) Ltd withholding services or pursuing legal action to recover the outstanding amount.
- Any costs incurred by NCH Events and Decor (Pty) Ltd for debt collection shall be the responsibility of the client.
Confidentiality:
- Financial details and payment-related information exchanged between you, the client and NCH Events and Decor (Pty) Ltd shall remain confidential.
Amendment or Termination:
- Any changes or amendments to the payment terms must be made in writing and agreed upon by both parties.
- NCH Events and Decor (Pty) Ltd reserves the right to terminate services in the event of non-payment or breach of contract by you, the client.
Cancellation Policy
- Kindly take note that in the event of a cancellation, whether it occurs early or close to the scheduled date, all deposits (reminder, this covers initial planning and preparation costs) or payments made will be forfeited. We regret any inconvenience, but refunds cannot be facilitated.
Governing Law and Jurisdiction
- These terms and conditions shall be governed by and construed in accordance with the laws of South Africa.
- Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of South Africa.
